Is online betting legal in India? The law in plain words
Gambling law in India is a mix of old state laws and a new national Act. This lesson sets out what the Promotion and Regulation of Online Gaming Act, 2025 says, when it took effect, and why none of it is legal advice.

Every page on Winzap Click carries a reminder that real-money online gaming is restricted in India. This lesson explains what that reminder refers to. It is written in plain words, it is not legal advice, and the law can change: check the current position where you live before you do anything.
The starting point: state laws
For most of India's history gambling has been a matter for the states. The Public Gambling Act of 1867 and the state laws modelled on it prohibit running or visiting a gaming house, with exceptions in a few states and for horse racing in some places. Those laws were written long before the internet, and for years the position of online betting was argued case by case.
The national Act of 2025
In August 2025 Parliament passed the Promotion and Regulation of Online Gaming Act, 2025. It was passed by the Lok Sabha on 20 August and the Rajya Sabha on 21 August, and received presidential assent on 22 August 2025. The Act prohibits online money games, which it defines broadly enough to include real-money games of skill as well as games of chance, while promoting e-sports and social (free) games.
The Rules under the Act were notified on 22 April 2026, and the Act and Rules came into effect on 1 May 2026. The Rules set up an Online Gaming Authority of India to classify games into online money games (prohibited), online social games and e-sports, to register the permitted kinds, and to enforce the categories. Our news section has the dates and sources.
Court challenges
Gaming companies have challenged the Act. The High Court cases were transferred to the Supreme Court in September 2025, and in August 2026 the Supreme Court agreed to a final hearing and asked the parties to complete their pleadings. At the time of writing no ruling on the merits has been issued, so the Act and its Rules stand.
What this means for the reader
- Betting on a sports exchange for money is gambling, and online money games are prohibited by national law in India. Offering them is an offence under the Act; the position of an individual user is a question for a lawyer, not for this site.
- Winzap Click does not offer any market, take any bet or hold any money. It explains how exchanges work as information, in the same way a book might.
- winzap.vip is a separate website operated, according to its own pages, under a Curaçao licence. Whether, where and by whom it may lawfully be used is not something Winzap Click can advise on.
- You must be 18 or older to use this site, and you are responsible for following the laws where you live.
Where to check
The text of the Act and the Rules is published by the Government of India, and the Supreme Court case can be followed on the Court's own website and the Supreme Court Observer. If you are unsure of your position, ask a qualified lawyer in your state.
This lesson completes the beginner level. The intermediate lessons start with in-play betting.
